Terms and Conditions

Hyperoptic’s “Switch now, pay no Package Charge* until later” business customer promotion (the “Promotion”) is open to new Hyperoptic business broadband customers who order our business broadband service for their premises while still receiving broadband services from another broadband provider (their “Current Provider”) at the same premises, subject to these Terms and Conditions. The Promotion allows eligible new Hyperoptic business customers to have both their Current Provider’s service and Hyperoptic’s service running at the same time, while they transition to Hyperoptic, and they won’t have to pay a Package Charge* for their new Hyperoptic service for between 3 and 12 months (depending on the remaining minimum commitment period for their Current Provider’s service), as set out in Clause 6 below.

  1. In these Terms and Conditions, “Hyperoptic”, “we”, “us” and “our” refer to Hyperoptic Ltd while “you” and “your” refer to you, our prospective business customer.
  2. This Promotion is only available to new Hyperoptic business customers:
    1. who sign up for any of Hyperoptic’s 24-month or 36-month minimum commitment 150Mb, 500 Mb or 1Gb Business Fibre packages for their premises (“Premises”) between 1st June 2023 and 31st March 2024 (both dates inclusive) via telephone call with one of our sales agents;
    2. who, immediately before such sign up, have no existing agreement for broadband service with Hyperoptic for those Premises; and
    3. who, at the time of such sign up, receive broadband service at the Premises from their Current Provider.
  3. If you tell us you have 3 or fewer months remaining of your minimum commitment period for your Current Provider’s broadband service at the Premises, and your Hyperoptic Order (as defined below in this Clause 3) is for a Business Broadband package with a 24-month minimum commitment, we will not require Proof (as defined below in this Clause 3) from you to apply this Promotion. Otherwise, to qualify for the Promotion, at the time you place your order for one of the Business Broadband packages referred to in Clause 2 a above (your “Hyperoptic Order”), you must provide Hyperoptic with a screenshot or other image of documentation/correspondence from your Current Provider (“Proof”) which clearly evidences:
    1. that you are currently receiving a broadband service at the Premises from your Current Provider; and
    2. the remaining minimum commitment period for your Current Provider’s broadband service at the Premises.
  4. The Proof you provide under Clause 3 above should not comprise the entire contract which you have with your Current Provider – just relevant excerpts of it or other communications with your Current Provider which provide us with the evidence required under Clauses 3 a and b
  5. It is Hyperoptic’s sole decision as to whether or not the Proof you provide is acceptable in connection with this Promotion. If you provide no Proof or if Hyperoptic is not satisfied with your Proof, and your Hyperoptic Order is for a Business Broadband package with a 24-month minimum commitment, we can apply the Promotion as if you had 3 or fewer months remaining of your minimum commitment period for your Current Provider’s broadband service at the Premises. If you qualify for this Promotion, it will be applied to your Hyperoptic Order as follows:

  6. When we use “month” in the table above, it means the period of time between the same dates in successive calendar months. After expiry of the Promo Period, you will be charged for your new Hyperoptic package as follows:

  7. When you have completed your Hyperoptic Order, you will receive an order confirmation email from Hyperoptic reflecting the Promotion.
  8. No Activation Charge will apply to your Hyperoptic Order under this Promotion.
  9. No Installation Fee will be payable under this Promotion if you opt for our standard installation (but extensions and bespoke installation services will be subject to applicable charges).
  10. No other Hyperoptic offer or promotional pricing can be used in connection with this Promotion.
  11. Hyperoptic’s services, under this Promotion or otherwise, are only available at premises which are already covered by our network.
  12. Hyperoptic’s Business Customer Terms of Service will apply to your Hyperoptic Order.
  13. Hyperoptic reserves the right to terminate, cancel, suspend, or amend this Promotion at any time.
  14. These Terms are governed by English law and you agree to the jurisdiction of the English courts.

* For the purpose of this Promotion, “Package Charge” means the monthly charge normally payable for any of our broadband-only, broadband plus phone or Hyperoptic’s Total Wi-Fi packages. For the avoidance of doubt, “Package Charge” does not include any Static IP Address Fee, Battery Back-Up Unit Fee, Installation Fee, Activation Charge, fees for Additional Telephone Plans (such as our UK Mobile Plan, Anytime UK Landline Plan, or International Plan), fees for “Chargeable Calls” (i.e. calls on our telephone service that are not included in your Package Charge or Additional Telephone Plan) or any other charges/fees related to our services.
